Mr. Agthe’s practice concentrates on the protection of intellectual property in the United States and abroad, including trademarks, copyrights and trade secrets, the negotiation and drafting of trademark, copyright and patent license agreements, technology transfer agreements, the prosecution of trademark and copyright applications, the prosecution and defense of trademark oppositions and cancellations in the United States Patent and Trademark Office, as well as intellectual property due diligence in connection with merges & acquisitions and financial transactions. Mr. Agthe also advises the firm’s clients with respect to cross-border and domestic corporate and commercial matters, including the formation of subsidiaries in the United States, agency, representative, distributorship, confidentiality and employment agreements and other contractual arrangements.
Prior to joining the firm, Mr. Agthe practiced international and domestic intellectual property law at the New York office of Alston & Bird LLP and its predecessor firm, Walter, Conston, Alexander & Green, P.C.
Mr. Agthe is a member of the International Trademark Association (“INTA”) and the Vice-Chair of the INTA’s Harmonization in Trademark Law and Practice Committee during the 2010-2011 committee term. He has taught Trademark Law at New York University’s School of Continuing and Professional Studies and has lectured on international trademark law, secured interest in intellectual property assets and the Uniform Domain Name Dispute Resolution Policy.
In November 2007, Mr. Agthe was the co-recipient of INTA’s Volunteer Service Award for the Advancement of Trademark Law, in recognition of his work representing INTA’s members interests before the United Nations Commission on International Trade Law (“UNCITRAL”) in connection with that body’s drafting of a Legislative Guide on Secured Transactions and a Supplement dealing with specific issues of security interests in intellectual property. Mr. Agthe continues to represent INTA at the meetings of UNCITRAL’s Security Interests Working Group and also serves as an expert consultant to UNCITRAL on issues relating to intellectual property security interests.
